About Us
Congratulations, you've won your court judgment. Now, what do you do with it?
 
If you are like most people, you don't have the time to learn the ins and outs of the legal system and are too frustrated to pursue the issue. However, I’d like to encourage you, if you want to better your chances of recovering your judgment, to read on.

A judgment is only good for so many years, depending on state law. It must be renewed before then, or it expires. During the life of the judgment, many things may be done to enforce it. This includes placing liens on real or personal property, levying wages, bank and stock brokerage accounts, and even having the sheriff go into a business to collect the day's receipts.

What Do I do?

I recover judgments which have been purchased and assigned from Judgment Creditors.  Each court-ordered judgment presented is individually evaluated and, if accepted, purchased.  No bailments (i.e.: temporary arrangements, collections “on behalf of”, etc.) are accepted, nor is any representation for another person or party is conducted.  I am not an attorney and do not render legal advice.

I am a member of the California Association of Judgment Professionals.  The CAJP is a statewide trade organization for Judgment Enforcement.  Judgments submitted may be small claims, limited civil or unlimited civil matters.   There is no dollar limit on what is accepted for purchase.

Making prudent and reasonable business decisions is vital in the business of enforcement of judgments.  The opportunity to review and evaluate judgments for purchase is appreciated from whatever source brings the referral, including small claims litigants, individuals in pro per, businesses, and attorneys.  The judgment may have been rendered from any jurisdiction -- small claims, limited civil or unlimited civil courts, and from any venue – local, state or Federal.

Evaluating judgments for purchase may include a review of public records.  The lack of, or amount of, public records available on a subject may be one of the factors which may influence a decision how, and if, I will purchase a judgment.  Under no circumstances is a consumer credit report or other personal (non-public) information gathered when evaluating a judgment.

Service Of Process and Skip Tracing

How It All Began

It all started in 1987, after I left my position as Collections Supervisor with Chrysler Credit Corporation. I was serving legal papers back then as a Registered Process Server in Los Angeles County (registration number 1478). When a judgment creditor asked for his assistance in collecting his judgment, I jumped at the chance to utilize my debt collector skills to recover what was owed. Since then, I have enforced court judgments, conducted collections, in-house investigations, skip tracing, repossessions, service of legal process, and, of course, judgment enforcement.

Judgment Enforcement is a specialized field. While traditional collection agencies depend on volume and persistent telephone calls and letters to harass and intimidate debtors into paying, Judgment Enforcement is different. Traditional collection agencies bring their revenue in through working on "claims" rather than facts (court rendered judgments). Because a judgment is a court order, monies recovered from debtors are most often times levied involuntarily, and legally. The credit card, medical and department store claims collections can be left to the other guy. (I do purchase returned checks in some instances in California, however.)
 
Judgment Enforcement is a business built on persistence and patience. Those who pursue judgment recovery must have the ability and knowledge to work within the legal system. Since the beginning, only judgments and returned checks have been accepted for assignment – no credit card, medical, or other “claims”. Although I am not an attorney, I have argued motions and presented my case before the courts, and had many court orders successfully issued.

All enforcement proceedings are conducted adhering to the Federal Fair Debt Collection Practices Act (FDCPA), the Fair Credit Reporting Act (FCRA) and the California Rosenthal Fair Debt Collection Practices Act (Rosenthal) and other applicable statute(s) and case law. Efforts to discover and execute against assets of the Judgment Debtor are done without the use and expense of an attorney whenever possible. Executions (levies, garnishments) may be made against:

Personal and real assets of Judgment Debtors, including: 

  • Bank accounts
  • Stocks, bonds and brokerage accounts
  • Automobiles
  • Collectibles and other items of value
  • Employment from other sources
  • Self-Employment
  • Other sources of income
  • Real estate, including primary residences, investment properties, and income properties.

The Book

After many years of enforcing judgments, I was encouraged to write such a book. In 2008, I finally published a book entitled, "A World of Opportunity: The Real World Judgment Recovery Guidebook".

Enforcement of judgments is more than just a business – it provides a service to the community. The courts will not enforce civil judgments, and most attorneys charge hourly fees. So most folks (and businesses) are stuck in the middle and don’t have access to resources effectively dealing with recovering their judgments. For many people who want to better themselves, learning about judgment enforcement is either a tool to recover their own judgments or to run a home based business.

"A World of Opportunity: The Real World Judgment Recovery Guidebook" is organized into three chapters (plus appendices and supplements):

The book is written for the person who wants not only to understand more about judgment enforcement, but who wants to be successful at running their own home based business. I’ve attempted to give real world, detailed, as opposed to theoretical examples of the subjects covered, and provided subsections within each chapter. Under the subsections, the reader may find:
